Terms of Service — Stoner Physics

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services provided by Stoner Physics LLC (“Stoner Physics,” “we,” “us,” or “our”) (collectively, the “Services”). Please read them carefully.

By downloading, installing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement of a parent or legal guardian who agrees to these Terms.

2. License

Subject to your compliance with these Terms, Stoner Physics grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Services for your personal or internal business purposes.

This license does not transfer any ownership rights. All right, title, and interest in the Services — including all software, designs, text, graphics, and trademarks — remain the exclusive property of Stoner Physics LLC and its licensors.

3. Restrictions

You agree not to:

Copy, modify, translate, or create derivative works of the Services;
Reverse engineer, decompile, or disassemble the Services, except to the extent that applicable law expressly permits it notwithstanding this limitation;
Rent, lease, lend, sell, sublicense, or otherwise transfer the Services to a third party;
Remove, obscure, or alter any proprietary notices;
Use the Services to violate any applicable law or regulation, or to infringe the rights of others;
Interfere with, disrupt, or attempt to gain unauthorized access to the Services or any related systems or networks; or
Use automated means to access the Services in a manner that imposes an unreasonable load on our infrastructure.

4. Third-party platforms

Applications distributed through third-party marketplaces are also subject to that marketplace’s terms. Where those terms conflict with these Terms with respect to the distribution or use of the application, the marketplace’s terms control to the extent of the conflict. Third-party marketplaces are not parties to these Terms and have no obligation to provide support for the Services.

5. Purchases and subscriptions

Some Services may be offered for a fee or on a subscription basis. Purchases are processed by the applicable third-party marketplace, not by Stoner Physics directly. Pricing, billing, renewal, and refund terms are governed by that marketplace’s policies. Subscriptions renew automatically until cancelled through the marketplace account settings.

6. User content

You retain ownership of any content you create using the Services. You are solely responsible for that content and for maintaining your own backups. We claim no ownership interest in your content and do not access it except as described in our Privacy Policy.

7. Privacy

Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Updates and availability

We may update, modify, suspend, or discontinue any part of the Services at any time. We may also release updates that are installed automatically by your device or marketplace. We will make reasonable efforts to provide advance notice of discontinuation of a paid Service.

9. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, STONER PHYSICS LLC DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STONER PHYSICS LLC AND ITS OFFICERS, MEMBERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TWENTY-FIVE UNITED STATES DOLLARS (US$25.00).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Stoner Physics LLC from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services or your violation of these Terms or applicable law.

12. Termination

These Terms remain in effect until terminated. You may terminate at any time by ceasing all use of the Services and deleting any installed applications. We may suspend or terminate your access if you materially breach these Terms. Sections 2 (ownership), 3, 6, and 9 through 14 survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws rules. You and Stoner Physics agree to the exclusive jurisdiction of the state and federal courts located in [COUNTY, STATE] for any dispute not subject to informal resolution.

Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at [email protected]. If we cannot resolve the dispute within 60 days, either party may pursue formal proceedings.

Nothing in these Terms limits any statutory rights you may have as a consumer under the mandatory laws of your country of residence.

14. General

These Terms constitute the entire agreement between you and Stoner Physics regarding the Services. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them freely.

15. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Material changes will be communicated through the Services or by other reasonable means. Continued use after the effective date of a revision constitutes acceptance.
